Florida Statute however made it illegal for a condominium association in Florida to charge a buyer a capital contribution fee (or working capital fee, new owner processing/administrative fee or new owner special assessment). This is the case EVEN if a capital contribution and the amount is explicitly written into the condo documents or as an amendment to the documents - as requiring a "capital contribution" from a buyer of a condo unit violates the Florida Condominium Act. NOTE: there are certain exceptions if the condominium also belongs to a MASTER HOMEOWNERS ASSOCIATION. B. With regard to ESAs , condo associations can legally request a signed, dated letter from a licensed healthcare provider who has personal knowledge of a buyer's disability-related need. Paid online registry certificates or ID badges carry no legal weight and can be rejected by condo boards. Condo boards cannot demand a buyer's full medical records or your specific mental health Under Florida Statute § 817.265, falsifying ESA documentation or misrepresenting a pet as an assistance animal is a second-degree misdemeanor. The above AND below information is not warranted nor guaranteed as 100% accurate. It is subject to inadvertent error, omission, miscalculation, misinformation and misinterpretation.
